Terms of Service
ClassVitals is a set of classroom checking-for-understanding tools, beginning with Mosaic, the vocabulary-puzzle tool, available at kohnpuzzles.com and classvitals.com (the “Service”). It is operated by James Kohn, an individual teacher in Texas, as an independent project (“we,” “us”). It is not owned, operated, or endorsed by any school district.
These terms are a plain-English agreement between you and James Kohn about using the Service. By creating a teacher account or using the Service, you agree to them. If you don’t agree, please don’t use the Service.
The short version
- Teachers create accounts; students never do. Students join a puzzle with a code from their teacher, and the teacher is responsible for how their class uses it.
- You own the puzzles and term lists you create. We use them only to run the Service for you.
- Treat the Service like a shared classroom tool: no unlawful content, no copying the software, no touching other people’s data.
- Right now the Service is free. If paid plans are introduced, you’ll see the price and terms before you pay anything.
- The Service is new and offered as-is. Keep your own copy of anything important (you can export results as a CSV file at any time).
- Student information is handled as described in the Privacy Policy, which is part of these terms.
1. Who can use the Service
Teacher accounts are for educators and other adults (18 or older). Students use the Service only as directed by a teacher: they join with a code and a name, don’t create accounts, and don’t need to agree to these terms. If you are a student, your teacher’s and your school’s rules apply to you.
Some schools and districts require approval before a teacher uses an online tool with students. Getting any approval your school requires is your responsibility. We’re glad to answer questions from your technology department (contact details below).
2. Your account
You can create an account with an email address and password, or by signing in with Google. If you use Google, we receive the name and email address on your Google account, and your Google account itself is governed by Google’s terms. Keep your sign-in details to yourself, and tell us if you think someone else has used your account.
One account per person. Don’t share accounts, sell or give away access, or create accounts for other people. We may require approval of new accounts before they can create puzzles, and we may refuse or close an account that violates these terms.
3. Your content
You own the term lists, definitions, distractors, puzzles, and class lists you enter (“your content”). By entering it, you give us permission to store, display, and process it as needed to run the Service for you — for example, turning your term list into puzzles for your students and showing you their results. That is the only reason we use it.
You are responsible for having the right to use what you enter. Short terms and definitions are ordinarily fine; don’t paste in substantial copyrighted material (a textbook’s own text, for example) without permission. Don’t enter anything unlawful, hateful, or inappropriate for students.
If a sharing or library feature lets you share a set with other teachers, sharing is always your choice. Shared sets may be used and adapted by other teachers within the Service. You keep ownership and can stop sharing at any time, though copies other teachers have already made may remain in their accounts.
We may remove content that violates these terms. If you believe content on the Service infringes your copyright, email us (below) with the puzzle code and a description, and we’ll look into it promptly.
4. Students and student information
Student information is handled as described in the Privacy Policy. In short: students are identified only by the name they type, we never sell or share student information, and any teacher, parent, or school can have it deleted on request.
Because you control what students enter, enter only what you need — a first name and last initial, or a class number, is enough. You are responsible for using the Service in line with your school’s policies and with the student-privacy laws that apply to you (such as FERPA). When you delete a puzzle, its results are deleted with it.
5. Acceptable use
Please do:
- use the Service for teaching and learning;
- supervise how your students use it.
Please don’t:
- try to access anyone else’s account, puzzles, or results;
- copy, scrape, reverse-engineer, or try to extract the Service’s code or data, or build a competing product from it;
- use bots or automated tools against the Service, or interfere with it (overloading, probing, bypassing security);
- post malware, spam, harassment, or anything unlawful;
- misrepresent who you are or claim an affiliation you don’t have.
Students who try to cheat a puzzle (sharing answers, starting extra attempts under new names, and so on) are a classroom matter between you and them. The Service records some signals to help you spot it; we don’t police classrooms.
6. Paid plans
The Service is currently free. We may introduce paid plans or make some features paid in the future. If we do, the price, billing period, any free trial, and the refund policy will be shown to you before you buy, and nothing will be charged without your agreement. Features that are free today may change or become paid; if that affects something you rely on, we’ll give notice as described in section 10.
7. Availability and changes to the Service
ClassVitals is new, run by one person, and improving quickly. We may add, change, or remove features, and the Service may occasionally be unavailable. We’ll try to give notice of major changes, but we can’t promise uninterrupted service. You can export your results as a CSV file at any time; we recommend keeping your own copies of anything important, such as grades you have recorded from puzzle results.
If we ever discontinue the Service, we’ll give at least 30 days’ notice by email to teacher accounts so you can export your data.
8. Ending your use
You can stop using the Service at any time and ask us to delete your account and data (see the Privacy Policy). We may suspend or close an account that violates these terms, or that has been inactive for more than two school years; where practical, we’ll email you first. Sections 3, 9, 11, and 12 continue to apply after an account ends.
9. Disclaimers and limits on liability
The Service is provided “as is” and “as available,” without warranties of any kind. We don’t promise that it will be error-free or always available, or that puzzle results are a complete measure of what a student knows — grading and instructional decisions are yours.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost data, lost profits, or lost time. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim or $50, whichever is greater. Some laws don’t allow these limits; where that is the case, they apply only as far as permitted.
You are responsible for your content and your use of the Service. If someone brings a claim against us because of content you entered or because you used the Service in violation of these terms, you agree to cover the resulting costs.
10. Changes to these terms
We may update these terms. The effective date at the top shows the current version. For changes that reduce your rights or add obligations, we’ll email teacher accounts at least 14 days before they take effect. Using the Service after a change takes effect means you accept it; if you don’t, stop using the Service and ask us to delete your account.
11. Disputes and governing law
If you have a problem with the Service, email us first — most things can be sorted out quickly. These terms are governed by the laws of the State of Texas, and any dispute that can’t be resolved informally will be handled in the state or federal courts located in Hidalgo County, Texas.
12. The whole agreement
These terms, together with the Privacy Policy, are the complete agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. If we don’t enforce a provision right away, we can still enforce it later. You can’t transfer this agreement to someone else; we may transfer it to a successor that continues to run the Service under these terms (for example, if the project becomes a company).
13. Feedback
If you send us suggestions or feature ideas, we can use them to improve the Service without owing you anything, and you don’t have to send them.
